Fallout continues after Conrad Black’s contentious appeals hearing

The fallout from Lord Black’s contentious appeals hearing included the now-familiar bumptious rebuttal from his Lordship, backed up by the usual ventriloquism offered up by George Jonas of the National Post. In all this, there was the assertion that judges Posner and Sykes were, as Black put it, “essentially part of the prosecution.” Whatever his motivation throughout the hearing, Posner was by turns caustic, sarcastic, incredulous and dismissive. Afterwards, Andrew Frey noted that it’s an appeals judge’s job to be skeptical and that it was unlikely that Posner would come off the bench and give him a hug.
In listening to the hearing several times, I was particularly struck by Frey’s opening remark regarding Black’s conviction for obstructing justice:
I have to say that I think this is the weakest case I’ve seen in 45 years of law practice. The judge and the jury both seem to have lost sight of the fact that in order to convict Mr. Black of obstruction it was necessary to find an intent to remove, conceal or destroy documents.
Remember, Frey is making this argument after a four-month trial that included hundreds of hours of argument and hundreds of pages of legal briefs to a justice of an appeals court (Posner) before whom St. Eve had appeared (at least indirectly) as a government attorney. Essentially, Frey is suggesting that a team of monkeys could have done a better job than St. Eve and the jury in this case.
There’s an old saying that it’s best not to shit where you eat. My guess is that Frey must have been absent the day that bit of wisdom was handed down from the gods.

Wow, imagine that! The National Post thinks Conrad Black got a raw deal. And wouldn't it be nice if all convicted criminals once owned newspapers like The National Post? George Jonas, as the former husband of Barbara Amiel was doing Conrad a BIG FAVOUR by writing that article. The wonders of right wing journalism, where "truth" can be manufactured for a price.

Since I have nothing new to add to Douglas Bell's comments above - which are spot on the mark and then some - I will simply cut and paste an earlier post or two I made on another thread immediately after reading CB's assessment of Posner, et.al, vis a vis the Apeals fiasco / Frey the legal frump and that mindless bumpkin Black's ( and Frey's opinions as well ) take on the Appeals' Judges themselves to whom, as Bell so correctly refers, are " monkeys ".....

Although my post is off thread topic, for which I apologize, I simply HAD to post the following link. it speaks for itself. Words absolutely fail me vis a vis the latest CBism. Either he is just plain nuts, seriously entering the early stages of Alzheimers, so completely absorbed with himself and no one else, or he has some weird sort of " death " wish. Clearly, with this most recent commentary via email from him, CB has lost any sense of reality; he lives in his own pathetic, irrelevant, obsolete, strange world much like Al Capone as he gradually lost his mind due to the ravages of syphylis while in prison for tax evasion.

To correct a possible misunderstanding, Bell is not referring to the learned Appeals Judges as " monkeys ", as I may have inferred and for which I am sorry, but he is calling FREY'S and BUMPKIN BLACK'S and JOKER JONAS' seeming opinions of Posner and his 2 collegues as " monkeys ". The only monkeys in this entire sorry joke are Frey, Black, and God bless him 'cuz I normally adore him, Dershowitz ( if he is indeed an advisor on this dumb Appeal ).

Havinmg just re read George Jonas' commentary in the National Post on behalf of his unofficial puppeteer, CB, I find myself thouroughly disgusted at his arrogant preumptiousness that the appellate judges were and are lazy and biased and did not take the time to properly review the convictions against Black. How the hell does this self described " legal expert " know how much time the learned Judges spent reviewing the trial / convictions? Or how informed and conscientious and honest they are? Who the hell is George Jonas anyway? Simply because this wizened, decrepit old weasel was formerly married to BA and therefore " impartial " as he suggests because if anything, he should really be against CB for marrying the " Lady ", his ex, does not therefore legitimize or validate his ignorant take on the ongoing legal battle to prove CB's innocence. All Jonas is a Black brownoser and puppet which render any support for Black laughable and ridiculous and disrespectful of those who have watched this scammer loot his companies and rightfully get convicted and sent to jail for same.

Black is no different from many other cons.....they continue to say they are innocent as they serve their sentence. If the innocent are not granted parole when they do not admit guilt to the parole board, I suspect CB will never gain any sympathy for an early release unless of course his health fails him.

There is simply NO PROOF that Conrad Black intended to subvert the course of justice in removing personal effects from his office in Toronto.

The next time your son, daughter, wife, husband is in the same situation and you cry "no proof" forget it. The courts, the judge, the appeal judges WANT Black to be guilty. It is good for the body politic. It gives the populace the idea that even a very rich man cannot "evade the course of justice."

Conrad Black is living in a democracy and was tried by its Justice System. Until man attains perfection and hence all laws and trials and verdicts, etc., will become perfect / flawless, our trials by jury or Judge are what our Constitution took years to proclaim. Black and his 2 bumbling Eddies had choices - 1) trial by jury of Black's peers ( they could have insisted and selected jurors with as much or more financial knowledge than their client ) 2) trial by Judge. A fair and equitable decision was reached by Black's jurors and they convicted him; the Judge sent him to jail. In a country with a Dictatorship, he might have have received many more years as a sentence. No Democratic system is perfect because human beings are imperfect creatures and these human beings set the laws of the land. According to our laws, Black broke them. And for years, skirted so closely to the line that divides legal from illegal and, in fact, DID break a few laws ( Hanna Mining debacle ) / Dominion Stores Employees Pension Fund....yadda, yadda, yadda. Eventually, the proverbial postman came calling / rang twice.
No one hates Conrad Black - but if they do, this might well have a tad to do with all that babbling drivel that dr kindly reprinted above, courtesy of The Star. Clearly, judging from that pathetic litany of hate, BLACK appears to hate everyone and his uncle. Or at very least, anyone who has the guts to stand up to this blowhard and B.S. artist. Conrad Black is a disgrace, a failure, a fraudster and a convicted felon. Case pretty much.....closed.

The expression of remorse, something that parole boards all across north America DO expect from the convicted person seeking an early release (obviously) is not found in a person who claims to be falsely imprisoned, innocent of the convicted crime.<<<just one of the many contradictions of our notion of justice.

I agree but I would estimate that most who claim they are innocent are, in fact, guilty. The other imperfection in our system of justice, which is of course unfair to the accused but not yet tried, is to often believe that the individual is unjustly presumed guilty until proved beyond doubt that he / she is innocent. Trial by media / court of public opinion is also unfair ( Sam Shepard trial, Ethel and Julius Rosenberg who went to the electric chair, the McCarthy era blacklists, the man convicted of kidnapping and murdering the Lindberg baby are all examples of imperfect justice ) and examples of the imperfections of Democracy and our ever evolving towards improvement and perfection justice system.

I agree with Grav'Lev that Spike Lee is by far a superior director compared to Clint Eastwood.I love and have rewatched many of his movies-especially Do the Right Thing, Crooklyn and School Daze. In their specific dispute I can see Eastwood has a strong point (the troops he dealt with in his historical WW2 movie didn't include many or any blacks). However he could have made this point to Spike Lee instead of just insultingly telling him to shut up. If anyone deserves to be taken seriously on these issues and owed the courtesy of a reasoned response it's Spike Lee.

I was merely quoting Eastwood's comments referencing Spike Lee's insulting and misinformed historical info re Eastwood's excellent film ( my opinion ) by claiming that Eaastwood did not focus upon the numerous Blacks who participated in WW2 and were not included in that famous photograph that was seen around the world and which became synonymous with US victory - Lee's insulting and dumb remarks deserved Esatwood's retort that Lee ought to " shut his face ". I was merely taking that remark and using it to tell George Jonas to shut HIS face too. What the hell do the directorial qualities of the 2 directors referred in my post have to do with anything OTHER than Eastwood's quote which I felt was totally applicable to Jonas' absolute stupidity? My father did 1 year in an federal correctional facility in Ohio for a crime that he did not commit, what happened was (briefly) when my mother got cancer in 1999 my father returned from Florida with her to Toronto get get her care and he signed his accountant on as president of his company. The company managed apartment builidings, in my fathers absence the accountant schemed with other accountants in the area to funnel tax advantages through a group a 4 companies into one where there amassed a 5 million dollar advantage, the group involved were all compensated for about $300,000 each, my father was unaware of this arrangement, recieved no proceeds from the scheme but the US government wanted the top guy, they went after my dad with all their force, they froze all of his us assets and funds pre trial and when they couldn't get my dad to plea bargain they indicted his lawyer so he could not defend himself, he was then broke and in pour health himself, after having a brain aneurysm and being rendered completely broke and destitute having $20 million dollars in assets seized by the US federal government before they proved anything, my father pled and did a year in federal prison for a crime he had nothing to do with. Anyone who thinks naively that because a court found you guilty therefor you are does not understand US Justice. I'm highly skeptical of the convictions of Conrad Black, I can't see the crime having read a little on this but the US dept. of Justice is nothing more or less than the most powerful criminal organization in the United States, anyone who;s witnessed their tactics would know this.

Why did he plead if he was innocent, as you claim? And re Conrad Black's convictions - first read the entire case as well as developments / evolving case, from A to Z starting in the year 2003. conrad black had a great fall (the national post and maclean's appear to be using denial as their coping strategy)
All the kings horses and all the kings men (that would be thatcherman and kissassinger translated) couldn't put conrad black together again (he lost his appeal and all that cash to lawyers who never stood a chance of getting that crook off)
Would it be appropriate at this juncture to say that conrad black's ass is bacon, that the price of greed is high? oink! oink! The man has expressed not one bit of remorse, shame on him and he gets what he promotes for others finally. How's it going in jail for him we all wonder? Jail sucks. We the general public want that punitive element no?
Will the national post and other mainstream rags including religious magazines used to target a captive audiences, still publish his opinions about everything? Nice double standard the public appears to ignore, lets hope these same people don't exercise their votes.

I could not have said it better myself, Jade_Lee. Wonderful post and kudos to you. I, too, wondered what will become of those doorstoppers he wrote and will anyone ever again believe a word that he has the gaul to pontificate upon. Forget the lectture tours when he gets out of jail - no one really gives a rat's a$$ what he says and anyway, he is a US deportee and never again to be permitted to enter my wonderful country - good riddance.
Congrats to Eric, Julie, Patrick, Edward, and Cramer - job well done. We love you guys... and lady...:-).
