Good topic.

Satire is the cutting edge of social commentary. Still, it must operate within the realm of truth. One cannot perpetrate a falsehood: "The Duke of Edinb*** is a screaming faggot and... " as long as he's alive. When he's dead, he's fair game, as Monty Python, for one, proves out: "Aristotle was a bugger for the bottle," etc.

Should there be limits? Probably yes. A parody of what someone actually said, or did, or inferred... is one thing. But to make up facts like: "he has sexual relations with his dog," etc (as Fintan does) is probably not the best way to present an argument.

I’m sure the lawyers Doug Bell referred to a few months ago will be very busy scrutinizing this blog. As I understand the Tyee suit, Asper’s claim bloggers are responsible for what is posted on their sites. You can be assured Mr. Bells statement “The parody satirizes the Sun’s avowedly pro-Israel editorial bent.” was vetted before it appeared here. “Avowed” just below “probably”.

Would I, be a target if I stated that I saw a direct correlation between the take-over of Black’s Canadian papers (Southam’s roster as well as the NP) by the Asper family and an immediate and definable swing to a pro-Israeli bias in those publications shortly after Aspers took over?

Should I have said “probable” or “avowed” connection?

The Canwest boys are showing they are prepared to throw their weight around. Figure David at least 225 and Len at 175 – that 400 lbs. of angry Asper coming at you.

And there will be lots of money thrown into this/these fights – after all, the legal costs will be written off as a corporate expense in some Canwest tax-offset claim.

But what really are they striking out at?

I wondered on this site, who had bankrolled the “Canada’s Daily Newspapers” splurge on national “Right to Know Day”.

Think about why Tubby’s name was put forward as peer potential. As “proprietor” of a major British daily, he threw his full support behind the UK gov’t . He regurgitated the Bush administrations WMD bumpf verbatim.

The National Post was a huge financial gamble predicated on his assumptions that a/ there was a very large number of influential Canadians who needed a rallying point and b/ the others he would convert by a daily drip of his concoction.

Which brings me back to the beginning – that I truly believe global media proprietors are spoon feeding us their own concoctions, within skillfully framed parameters, within which they wish to contain our contemplations and conversations.

As to the “Right to Know” bit I saw it in the Victoria Times Columnist – an Asper organ – last Sept - a 2 page insert as below.

Regarding the Black-ASsper connection, does any one else here remember, way back when the first charges were being bandied about, that there was a question about who had asked for the non-compete between Black and Canwest.

It's kind of fuzzy but I think there was a suggestion that this was one of Black's "afterthoughts" but then Izzy was dead and then a letter surfaced that purported to prove that it was in fact Izzy's request?

Like I say, my memory is kind of fuzzy on this but I think that letter was why the Canwest deal, although the biggest and the one that netted the biggest payout for Black was not included in the Chicago trial.

Anyone out there know the exact details?

I went back into the old Black Watch blog threads and I found a post by Leaf that was allegedly proof of Fintan's peophilia. It was a collection of previous quotes by Fintan. If that is indeed Leaf's "proof", then any reasonable person would agree with Fintan in that there is no need for him to deny anything.

But I do agree with Family Guy in the sense that if Fintan genuinely believes Leaf has suffered sexual abuse as a child, then it's unkind of Fintan to refer to that abuse in a joking manner while addressing Leaf.

Being mean to someone is not a crime, however. Making nuisance calls, bragging about nuisance calls, enouraging others to make nuisance calls is a much more serious matter.

This CanWest fiasco reminds me of a Daily Telegraph fiasco: how George Galloway was falsely accused of being a traitor to England PLUS being anti-semitic. Turns out he wasn't either of those things. But he DID say that [Telegraph publisher] Lord and Lady Black were great supporters of Israel, which in itself isn't a lie or an insult! This gave the motive they were libelling his name though, since he was both anti-Iraq war and pro Palestian.

The MP for Glasgow Kelvin is suing the Daily Telegraph for libel over claims he received payments from Saddam Hussein.

"You said I referred to Lady Black as Jewish. It was a lie, a lie, a lie," Mr Galloway told Mr Price.

In fact, Mr Price then conceded, the letter had referred to Ms Amiel and her husband Lord Black as "two of [Ariel] Sharon's, Israel's, most vociferous supporters".

"In what sense is that a reference to someone's religion?" demanded Mr Galloway. "This is an outrage."

Regarding the Black-Asper connection, does any one else here remember, way back when the first charges were being bandied about, that there was a question about who had asked for the non-compete between Black and Canwest?

It's kind of fuzzy but I think there was a suggestion that this was one of Black's "afterthoughts" but then Izzy was dead and then a letter surfaced that purported to prove that it was in fact Izzy's request?

Like I say, my memory is kind of fuzzy on this but I think that letter was why the Canwest deal, although the biggest and the one that netted the biggest payout for Black was not included in the Chicago trial.

BBC – I looked into the Galloway libel case and yes, he indeed won in the High Court. Black had to pay him 150,000 Pounds Sterling in damages and another 1.2 million P.S in costs.

Some interesting collaterals. For one "The Telegraph claimed it was in the public interest to publish its story regardless of whether it was true." Sounds like Black, eh?

The Telegraph appealed the verdict to the Court of appeal but lost there too.

A very interesting sidebar is that the British Courts extended (about 10 years ago) the defense of "qualified privilege" to newspapers in the UK.

In Canada, as far as I know, "qualified privilege" is reserved to protection of public officials who act, in the absence of malice, with the belief that an issue is of such importance to the national (or provincial) interest that they feel compelled to take whatever action they consider appropriate and is available. They are protected, whether or not what they do is wrong, if they genuinely believe they are acting in the public interest and do so without malice.

Proving malice, when the real objective by those public servants is simply to stifle a dissenting voice, can be very difficult, especially in the “Old Boy’s Club” that seems to me such a large component of Canadian jurisprudence.

In the absence of malice, the fact that a statement is true, is in itself a defense against defamation.

I was very curious when last year "Canada's Daily Newspapers" put a 2 page ad (replicated at the top of this thread) in the Victoria Times Columnist - an Asper title.

The ad stated that Sept 28th was International Right to Know Day. I didn't know that, nor did I see it mentioned on other media. I inquired on this blog as to whether anyone had seen the same ad placed in other newspapers around Canada but there was no response.

The ad also said : “Right to Know is a principal that states citizens have the right to free, timely access to information on what our government is doing.” (Principle, Duh!)

So where is this “Principal” enshrined? Even a guess would be helpful.

Call me a cynic, but think about it. I don’t know who said it but “Freedom of the Press only extends to those who own one” is fairly well known.

My sister Pat was a happy, healthy little girl. Until she gave a goodnight kiss on our front porch to a very nice boy who had taken her to a school dance. After she came in the house my mother slapped her and called her a “miserable slut”. My mother was a morphine addict. My father, a physician, after having given mom her fix, used to slip into sister Pat’s bed.

I had no knowledge of it at the time. I had already run away from home and only heard the facts a few days before Pat took her life. She had been a ladies lady for her entire adult life but I never judged her for it one way or another. She was my sister and the dearest, closest friend I ever had.

She told me that because of the ongoing rape and molestation by our father, that she had never been able to feel comfortable with men and thus turned to love from women. Until she was 50, and the old creep died and she felt she really wanted to find love with a man.

Up to that point she had been a staunch citizen of BC’s premier town for gay people. When she told her compatriots of her desire she was ostracized and heaped with ridicule. Shortly after which, she took her life.

Another of my closest friends came from a large catholic family. He hinted a few times about his confusion with his church and the difference between the words and the reality but I never pressed him on it.

Twenty years passed and he came to see me in BC, out of the blue. He was really troubled and told me that he had been repeatedly abused by a priest and when he had tried to tell his parents he had received a major beating. While working on a pipeline job he had gotten a woman pregnant and married her but it was not a good marriage. Thinking that finally he was with someone who would understand and help him exorcise the demons caused by that perverted old priest he told her what had happened. She ridiculed him and he too took his own life.

So, back to freedom of speech. Is it ok that, based on life experience, I continue to believe that badly bent people, including parents and Catholic priests, are the major source of people growing up with sexual identity crises?

In short, if I do not agree that homosexuality is normal and genuinely believe that it should not be propagated in our schools - firmly based beliefs from real life experiences - are my thoughts crimes?

Well, no, not exactly. We are all entitled to our own thoughts and beliefs but there are limits as to what we can express in a public forum. Is this blog such a forum?

Keep in mind I am not denying that a very sick man called Hitler was able to lead Germans into perpetuating horrific crimes against humanity. Nor am I trying to say that there really were WMD’s in Iraq but the western forces just couldn’t find them.

I am only saying that we are all entitled to come to our own beliefs and entitled to state them openly.

I don’t mean to offend anyone by these statements. I hold them as self-evident truths and wish they weren’t so.

I cannot personally understand how anyone can be so debased as to kill another person. But our imprint is that it’s OK if we slaughter religious wing-nuts with funny hats in far-off lands. Or if you live in Texas and find your wife in bed with another man, you can shoot them both and walk.

We have a long way to go, on many fronts, before we can shrug off the imprints that so foul our makeup and behavior.

I thought it very pertinent that the Pope, on his visit to America, met privately with some victims abused by his agents, spoke of the horror and pain but couldn't bring himself to offer an apology.

My Editor, when I wrote the timber column for Equity Magazine also took his life. He had rebelled against the family (Southam) and struck out on his own. Then was called back to the fold with the title of Editorial Director. He sat in an office in Don Valley and made the decisions as to what went to press and what got spiked. And came to hate himself so much for what he was perpetuating that he decided to check out.

We all make our own choices and decisions and any of us can decide to check out if it's not working out but what seems to be disappearing, in our world of instant gratification and retribution, is the sharing and caring that people build on, to make things better.

I have to confess that although only an occasional visitor here, I became appalled at how snippy and trite most discourse had become.

Barbara in BC, I am not trying to be funny when I goad leaf. I am hitting back at a malicious, evil, warped personality. I do it by harping on what I theorise made her the way she is.

What else could have created such an obsession with paedophilia? Leaf does not know me, nor what or where I am, but concludes from posts that I have made on an open blog that I am a child molester. Every word I have written is preserved on the server. It has been many months since she first made that accusation, and not a shred of proof has she produced. And I am still here, and still lambasting His Lardship and Morticia. How would you feel about someone who accuses your husband of being a paedophile? In earlier posts, leaf has accused my wife of being "promiscuous", argued that I am not the father of our children, sent false reports to the Finnish police, incited people to attack me, etc., etc.

In return, I play on what I suspect are her weaknesses, and I'll be only too delighted if it goads her to the point where really nasty consequences happen to her.

I don't believe in turning the other cheek. Look what happened to the last guy to do that!

It was leaf who began attacking me, not the other way round. She has tried in every way within her limited powers to annoy and scare me. Until she states clearly on this blog that she withdraws her accusations, I will continue to remind her of her tragic past and we shall see how far she is prepared to go with her mischief-making.

Note that the Pope said nothing about homosexuality in his clergy but only spoke of abuse to minors. And didn't offer any apology. And refuses to consider a registry for offenders under his command, so communities are aware of the history of "the new priest" in town.

Our take is that Mr. Bell and other Toronto Life staff do indeed care but also insticntively and correctly surmise that the awful problem of stalkers, harrassers and those who threaten others, etc., will eventually correct itself via legitimate and serious posters to this blog, such as me, Barbara_in_BC, Fintan, with sufficient knowledge, funds, resources to derive justice and legal assisstance to help rid the blog of extremely disturbed predators like Family_Guy. TL probably already knows that someone like me will be sufficiently alerted to take the matter of these very ill predators into our own hands and seek the necessary solutions for their ultimate removal from this blog, the internet and hopefully from the lairs from where they post their warped, illegal and quite sick ramblings.

Casey, I think you put your finger on it. I also understand that TL probably wants to let a thousand flowers bloom, so to speak, and let the debate range far and wide. It's not just their problem that sickos try to take over. What would leaf and "No Family Guy" do if everyone else left? Talk to each other? Unfortunately, creeps like this pollute every blog.

I think you are right in surmising that TL is just willing to give those creeps enough rope and they will hang themselves. As His Lardship found out the hard way, you can sail mighty close to the wind for a very long time, but karma is always waiting in the wings with that little extra gust that pushes you across the line.

In his case it was the surveillance camera he thought wasn't working. In the case of the great train robbers in England in the 1960s, it was half a fingerprint on a salt cellar that got them caught. They had wiped everything clean and left not a trace, but then one of them felt like having a ham sandwich ...

In their case, it will be something just as small. Making false reports to the police is a good example. They may laugh at an obvious nutbar now and then, but if she persists and they have time on their hands, the ball gets set in motion. You can be sure that this blog is being followed with great interest in Helsinki - and I don't just mean at the Canadian Embassy, who have been informed about it - by guess who! LOL I've heard the Ambassador, Scott Fraser, who is very well liked and respected here, is squirming with embarrassment.
